GENERAL TERMS AND CONDITIONS – OPEN-IT CARE

Article 1 – Definitions

  1. Open-It Care: The general partnership established in the Netherlands.

  2. Customer: A natural person not acting in the exercise of a profession or business.

  3. Distance Agreement: An agreement concluded through the webshop.

  4. Webshop: https://open-it.store and related domains.

  5. Product: The 5-in-1 multitool or related products offered by Open-It Care.

  6. Withdrawal Period: The period during which the customer may exercise the right of withdrawal.

  7. Right of Withdrawal: The possibility for the customer to cancel the agreement within the withdrawal period.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by Open-It Care and to every distance agreement concluded.

  2. The text of these terms and conditions will be made available to the customer before the agreement is concluded.


Article 4 – The Offer

  1. The offer contains a complete and accurate description of the product.

  2. Obvious mistakes or errors in the offer are not binding on Open-It Care.

  3. All stated prices include VAT and exclude shipping costs unless stated otherwise.


Article 5 – The Agreement

  1. The agreement is concluded at the moment the customer accepts the offer and complies with the applicable conditions.

  2. After the agreement has been concluded, the customer will receive an electronic confirmation of the order.


Article 6 – Right of Withdrawal (14 Days)

  1. The customer may cancel an agreement regarding the purchase of a standard product within 14 days without giving any reason.

  2. The withdrawal period starts on the day after the customer, or a third party designated by the customer, receives the product.


Article 7 – Obligations of the Customer During the Withdrawal Period

  1. The customer must handle the product and packaging with care.

  2. The customer may only inspect and handle the product as they would in a physical store.

  3. The customer is liable for any reduction in value of the product resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.


Article 8 – Exercising the Right of Withdrawal

  1. The customer must notify the withdrawal within 14 days by:

    • using the model withdrawal form, or

    • sending an unambiguous statement by e-mail.

  2. The customer must return the product within 14 days after notifying the withdrawal.

  3. The direct costs of returning the product are borne by the customer.

  4. The risk of return shipment remains with the customer.


Article 9 – Obligations of Open-It Care in Case of Withdrawal

  1. Open-It Care confirms receipt of the withdrawal notification.

  2. Open-It Care refunds all payments received from the customer, including standard delivery costs, within 14 days after receiving the withdrawal notification.

  3. Open-It Care may withhold reimbursement until the returned product has been received or until the customer provides proof of return shipment, whichever occurs first.

  4. Refunds will be made using the same payment method used for the original transaction.


Article 10 – Exclusion of the Right of Withdrawal (Custom Products)

The right of withdrawal does not apply to:

  1. Products manufactured according to the customer’s specifications and not prefabricated.

  2. Products that are clearly personal in nature, such as personalized or engraved multitools.

  3. Sealed products that are not suitable for return due to health protection or hygiene reasons and whose seal has been broken after delivery.

Goodwill Arrangement

Open-It Care may, at its own discretion and without obligation, decide to accept the return of a custom-made product. No rights can be derived from this voluntary arrangement.


Article 11 – Delivery

  1. Delivery takes place at the address provided by the customer.

  2. The delivery period is a maximum of 30 days unless otherwise agreed.

  3. The risk of damage or loss remains with Open-It Care until the moment of delivery to the customer.


Article 12 – Payment

  1. Payment must be made using the payment methods offered in the webshop.

  2. The customer is obliged to report any inaccuracies in payment details immediately.


Article 13 – Conformity and Legal Warranty

  1. Open-It Care guarantees that the product complies with the agreement and with the reasonable expectations the customer may have.

  2. The statutory warranty fully applies.

  3. Any additional warranty provided by Open-It Care does not affect the customer’s legal rights.


Article 14 – Complaints Procedure

  1. Complaints regarding the performance of the agreement must be submitted within a reasonable time after discovery by e-mail.

  2. Open-It Care will respond to complaints within 14 days after receipt.

  3. If a complaint requires a longer processing time, the customer will receive an indication of the expected response period within 14 days.


Article 15 – Liability

  1. Open-It Care is not liable for indirect damages.

  2. Liability is limited to the purchase amount of the relevant product unless there is intent or gross negligence.


Article 16 – Governing Law

All agreements are exclusively governed by Dutch law.
